These Terms and Conditions (“Terms”) govern your use of the She Grows Veg mobile application (the “App”). By downloading, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the App.

Eligibility and Availability

1.1 The App is intended for users located in the United Kingdom only. By using the App, you represent and warrant that you are resident in the UK.
1.2 You must be at least 16 years old to use the App. If you are under 18, you confirm that you have obtained parental or guardian consent.
1.3 We do not guarantee that the App or its content will always be available or uninterrupted. We may suspend, withdraw, or restrict access for operational, business, or legal reasons.

Account Registration and Security

2.1 To access certain features of the App, you may be required to create an account and provide personal information (including but not limited to your name, email, age, phone number, and location).
2.2 You must ensure that all information you provide is accurate, complete, and up-to-date.
2.3 You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.

Permitted Use of the App

3.1 The App is provided for personal, non-commercial use only.

3.2 You may use the App to:

Diagnose problems with your vegetable plants;
Identify vegetable plants;
Plan your vegetable patch and receive notifications for sowing, tending, and harvesting;
Access learning resources including blogs and videos;
Purchase She Grows Veg products.

3.3 You must not use the App:

For any unlawful, fraudulent, or harmful purpose;
To copy, reproduce, or exploit any part of the App without express written consent;
To introduce viruses, trojans, or other malicious code.

Intellectual Property Rights

4.1 All intellectual property rights in the App and its content (including text, graphics, logos, photographs, videos, learning content, and software) are owned by or licensed to She Grows Veg Ltd.
4.2 You are granted a limited, non-exclusive, revocable licence to use the App solely in accordance with these Terms.
4.3 You may not copy, modify, distribute, transmit, display, reproduce, or create derivative works without our prior written consent.

Purchases and Payments

5.1 Purchases of products made through the App are subject to separate She Grows Veg Ltd Terms of Sale, available at the point of purchase.
5.2 Prices and availability of products are subject to change without notice.

Privacy and Data Protection

6.1 Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
6.2 By using the App, you consent to the collection, processing, and storage of your personal data as described in our Privacy Policy, in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Disclaimers

7.1 The App provides general information, advice, and guidance relating to vegetable growing. It does not constitute professional or specialist agricultural advice.
7.2 Whilst we make reasonable efforts to ensure accuracy, we make no warranties that the information provided is complete, up-to-date, or suitable for your specific circumstances.

Limitation of Liability

8.1 Nothing in these Terms shall exclude or limit our liability for:

Death or personal injury caused by our negligence;
Fraud or fraudulent misrepresentation;
Any other liability which cannot be excluded under UK law.
8.2 Subject to clause 8.1, we shall not be liable for any loss or damage arising from:
Your reliance on the App’s content;
Business losses, including loss of profit, loss of business, business interruption, or loss of business opportunity;
Loss or corruption of data;
Events beyond our reasonable control.

Termination

9.1 We reserve the right to suspend or terminate your access to the App at any time, without notice, if you breach these Terms.
9.2 Upon termination, all rights granted to you under these Terms shall cease immediately.

Changes to These Terms

10.2 Continued use of the App after such changes shall constitute your acceptance of the amended Terms.

Governing Law and Jurisdiction

11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
